Acceptance and scope

These Website Terms form an agreement between you and FirstFold Studio (“FirstFold,” “we,” “us”) when you access or use firstfoldstudio.com, including the free website analysis. If you do not agree, do not use the site or submit a URL.

You must be able to form a binding agreement where you live. If you use the site for an organization, you confirm that you are authorized to act for that organization in relation to the use.

Our Privacy Notice explains how we handle personal information and is incorporated into these Terms for that purpose.

Website use is not a client agreement

These Terms govern use of the public website and free analyzer only. They do not create a designer-client, consultant-client, fiduciary, partnership, employment, or exclusive relationship.

Any paid project requires a separate proposal and signed services agreement that states the parties, scope, price, currency, taxes, payment schedule, timetable, review rounds, ownership, support, and termination rights. That signed agreement controls the paid engagement if it conflicts with these Website Terms.

Package descriptions, prices, timing, and availability shown on this site are general information, not a binding quote or offer. Unless a later written agreement says otherwise, displayed prices are in Canadian dollars and applicable taxes are additional.

The website analysis

What it does

The website analysis is a bounded, automated review of one public homepage and public responses at robots.txt, llms.txt, and sitemap.xml. It can use Google PageSpeed Insights to render the homepage in phone and desktop conditions and return automated speed, accessibility, browser-reliability, and search-readiness evidence. An optional screenshot review can assess only the visible first impression. The analysis does not crawl the full site, reproduce every real device or network, test every accessibility requirement, verify search indexing, or ask an AI product whether it will cite or recommend a business.

Your authorization

You may submit only a publicly available website that you own, control, or are authorized to assess. You must not submit an internal, private, authenticated, or access-restricted location; an address intended to reach local or cloud infrastructure; or a URL for the purpose of testing another person's security without authorization.

How to read a report

The report is automated, limited to what the checker retrieved at that time, and may be incomplete, stale, or wrong. It is general informational output, not legal, security, accessibility, accounting, SEO, advertising, or other professional advice. A score or finding is not a certification, endorsement, or finding of legal compliance.

Preview and email delivery

The page may show a preview and ask for an email address before opening and sending the complete report. Requesting that report asks for one transactional email and does not subscribe the address to marketing. Provider acceptance does not guarantee inbox placement, and a later bounce or filtering decision remains possible.

Acceptable use

You must not use the site or the website analysis to:

• break a law, violate another person's rights, or submit information you are not permitted to use;
• probe private networks, bypass access controls, defeat rate limits, scan ports, or test security without authorization;
• introduce malicious code, interfere with availability, overload the service, or use automated requests beyond ordinary interactive use without written permission;
• impersonate another person, send a report to an address without the recipient's involvement, or use FirstFold's email delivery as a relay;
• misrepresent an automated report as a FirstFold certification, guarantee, endorsement, or complete professional audit; or
• copy, frame, republish, resell, or exploit the site, report system, visual design, or content except as these Terms expressly allow.

We may limit, suspend, or block access when reasonably necessary to protect users, providers, FirstFold, or the service, or to investigate suspected misuse.

Website content and availability

We try to keep public information accurate and the site available, but we may correct, update, remove, suspend, or discontinue content or features without notice. Portfolio items are labelled according to their stated status; external project sites can change after capture or publication.

You remain responsible for decisions made from website content or a report, including obtaining qualified advice and independently verifying important facts. Keep your own copy of any information needed for your records.

Intellectual property

The FirstFold site, its original copy, visual system, layouts, code, graphics, and analysis presentation are owned by FirstFold or used with permission and are protected by applicable intellectual-property laws. “FirstFold Studio” and related presentation may not be used to imply affiliation or endorsement.

We grant you a limited, revocable, non-exclusive, non-transferable permission to access the site and use a report for your own internal evaluation. The target website's content remains the property of its owner. No ownership in that content transfers to FirstFold merely because the checker reads a public response.

Third-party services and links

The site links to services and sites operated by others, including Google Calendar, Stripe-hosted payment pages when offered, and portfolio or demonstration sites. Those services have their own terms, privacy notices, availability, and security practices. A link does not make FirstFold responsible for third-party content or conduct, and inclusion does not imply endorsement unless we say so expressly.

Disclaimers

To the maximum extent permitted by law, the public site and free website analysis are provided “as is” and “as available,” without warranties or conditions of accuracy, completeness, fitness for a particular purpose, merchantable quality, non-infringement, uninterrupted availability, or error-free operation.

Nothing in these Terms excludes a warranty, condition, remedy, or other right that applicable law does not permit us to exclude. Warranties for paid services, if any, are stated only in the signed client agreement.

Limits of liability

To the maximum extent permitted by law, FirstFold will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss arising from the public site or the website analysis, or for lost profit, revenue, opportunity, goodwill, data, or business interruption, even if the possibility was known.

For claims arising solely from the free public site or website analysis, FirstFold's total aggregate liability will not exceed the greater of CAD $100 and the amount you paid FirstFold specifically for that use during the 12 months before the event giving rise to the claim. Liability for paid client work is governed by the signed client agreement.

These limits apply only to the extent allowed by law and do not limit liability that cannot lawfully be limited, including any non-waivable consumer right.

Ontario law and general terms

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Subject to any non-waivable right to bring a claim elsewhere, the courts of Ontario have exclusive jurisdiction over disputes relating to these Terms.

If a provision is unenforceable, it will be limited or removed only to the minimum extent necessary, and the rest will remain in effect. A delay in enforcing a provision is not a waiver. You may not transfer these Terms without our written consent; FirstFold may transfer them as part of a legitimate reorganization or transfer of the business. These Terms and the incorporated Privacy Notice are the entire agreement for the public site and the website analysis, but not for paid client services.
